§ 15-4. Conditions of rate authorization.

(a)

Eagle Pass Natural Gas Corporation shall file with the city, no later than the first billing day of each month, a report detailing the amount of the weighted cost of gas to Eagle Pass Natural Gas Corporation for that billing period.

(b)

Eagle Pass Natural Gas Corporation shall file with the city, not later than the thirty-first day of March, each year, a copy of its financial statement, as such statement is prepared for the board of directors of said corporation. Such statement shall include a detailed accounting of the status of the debt owed Valero Energy Corporation.

(c)

Eagle Pass Natural Gas Corporation shall file with the city, no later than the thirty-first day of March, each year, a copy of the annual report which said company is required to file with the Railroad Commission of the State of Texas.

(d)

Eagle Pass Natural Gas Corporation shall make every effort to initiate an intensive consumer awareness campaign, using any and all means of communication available to them.

(e)

Eagle Pass Natural Gas Corporation shall make every effort to institute an optional equal payment plan for the consumers of natural gas in the city.

(f)

At any time hereafter that the city council determines that the margin of profit of Eagle Pass Natural Gas Corporation is excessive, said council hereby reserves the right to renegotiate the rate structure herein authorized.
