§ 16-14. Enforcement.

  • Any person or entity that violates any provisions of this article or shall fail to comply with any of the requirements thereof, or of a certificate/permit issued under the provisions of this article shall be guilty of a misdemeanor punishable by a fine of up to two thousand dollars ($2,000.00). Except as otherwise provided, proof of criminal negligence is required for conviction of an offense under this article. Proof of a higher degree of culpability than criminal negligence constitutes proof of criminal negligence. Each day that a violation continues shall be deemed a separate offense. Persons issued citations for violations of this article are not subject to the board's appeal procedure.

    The city attorney may bring suit to: (1) recover a civil penalty not to exceed one thousand dollars ($1,000.00) a day for each violation of this article; and /or (2) enjoin a violation or a threat of a violation of this article; and/or (3) enjoin an individual or entity from operating without a permit if a permit is required. If the city prevails, in whole or in part, the city may also recover its attorney fees and costs of bringing the suit.
