§ 18-21. Authority to file complaint for overdue material.

  • The director of the library or any person authorized by the director may file a complaint in the Eagle Pass Municipal Court against any person violating the provisions of this article if:

    (a)

    A certified letter, return receipt requested, is mailed to the offending person informing such person that the book, or books, article or materials are more than six (6) weeks overdue and that failure to return the books, articles, or materials within ten (10) days shall cause a complaint for prosecution to be filed for violating this article and that failure to return is presumed to be intentional to defraud and retain library property.

    (b)

    In the event the original violator is a minor, the said certified notice shall be sent to the parent or guardian of said minor.
