Chapter 22. STREETS, SIDEWALKS AND OTHER PUBLIC PLACES |
Article I. IN GENERAL |
§ 22-5. Discharging certain liquid and other matter prohibited; exception; definitions.
It shall be unlawful to introduce, discharge or run, or to suffer, cause or permit the introducing, discharging, or running, of any fluid or water containing either oil, grease, soap, lye, gasoline, kerosene, naphtha, washing powder, mud, refuse, sewage waste or filth, or any combination thereof, upon or into any public street, alley or sidewalk, within the city.
(a)
Provided however, that the washing of passenger vehicles, walks or driveways with a reasonable amount of mild detergent and flushed with clear water from a hose not to exceed three-fourths (¾) of an inch in diameter, and operating on normal city water pressure, shall not be deemed a violation of this section even though water incidentally spills over into the city streets, provided the water does not extend into the traffic lane.
(b)
For purposes of this section the term, traffic lane shall be construed as meaning that portion of the roadway beginning at a point three (3) feet out from curbline adjoining the location involved; and the words, passenger vehicles specifically exclude trucks.
(c)
In locations where drainage conditions do not permit complete runoff and pooling of water results between the curb and the traffic lane, the person responsible for such pooling shall be responsible for the immediate removal of such pooled water or liquid within the next ensuing eight-hour period or shall be deemed in violation of this section.
(d)
Spots on walks or driveways may be dissolved or washed in the manner described in subsection (a) above; but the flushing of liquid containing oil, grease, gasoline, kerosene, naphtha, or other solvents detrimental to asphalt into the city streets, as hereinbefore prohibited, shall be deemed in violation of this section.
(e)
None of the foregoing shall be deemed in violation of this section when done in the cleaning, improvement, construction, treatment or repair of public ways by or under authority of the city. Sections of this Code dealing with water conservations are not waived under this section.
