§ 22-15. Petition, duties of city manager; hearings.

  • Upon written and signed petition of sixty (60) percent of the owners of real property, or of the owners of sixty (60) percent of the real property, abutting on a given section of public thoroughfare within the corporate limits of the city and which thoroughfare section is properly and lawfully subject to paving by the municipality, the city manager shall prepare a preliminary report of engineering, and an estimate of cost covering such proposed paving and shall present it, together with the petition, to the city council for review and consideration. If such project is approved by the city council and funds are available, the city attorney shall prepare the legal realty improvement documents. A public hearing shall be had after proper notice thereof, all in accordance with the Home Rule Charter of the City of Eagle Pass and the laws of the State of Texas, inclusive of, but not limited to, Vernon's Annotated Civil Statutes, art. 1105b.
