§ 22-25. No work to be done on streets without permit.

  • It shall be unlawful for any person to cut, break, puncture, excavate or otherwise damage, in any manner whatsoever, any portion of the surface of any public street, alley, curb or sidewalk located within the corporate limits of the city and maintained by the city, without first having obtained a written permit issued by the public works director and/or his designee for such purpose and authorizing the same to be done. All water districts or water supply corporations are given rights-of-way within, along, under, and across all public, state, county, city, town, or village roads, highways, and right-of-way and other public rights-of-way without the requirement for surety bond or security; provided however, that the entity having jurisdiction over such roads, highways, and rights-of-way may require indemnification. All utility companies whether subject to the payment of the permit fee or not must obtain a street cut permit. Emergency repairs performed require that a permit be obtained no later than twenty-four (24) hours after the incident or the next business day.
