§ 22-38. Display of merchandise prohibited; exceptions.
(a)
It shall be unlawful to deposit, display or store any merchandise, food or economic good upon any portion of a sidewalk, or thereon to construct, erect, install or place any case, stand, table or other type of receptacle, structure or fixture whatsoever for any such purpose.
(b)
The prohibitions of this section shall not apply to any permanent fixture actually installed and affixed on or along a sidewalk prior to the effective date of this section. The term, permanent fixture, as used herein shall mean and be held to refer to any object which is bolted or otherwise securely fastened into a paved surface and also embedded within, or otherwise securely attached to underground object(s) beneath, the ground surface.
(c)
The prohibitions of this section shall not apply to the actual movement of merchandise or economic goods over or across sidewalks when such movement is accomplished as one (1) continuous transaction of temporary duration to or from building entrances and/or vehicles in sale, storage or other transfer for a lawful purpose.
