§ 22-53. Form of ordinance closing streets, etc.

  • Should the city council finally determine that said street, alley or public way should be closed and abandoned, the following form of ordinance shall be used for closing all streets, except in those instances where such form is not applicable and in which event, the city attorney may use a different form to comply with the particular circumstances that exist.

    "ORDINANCE NO. _____

    AN ORDINANCE PROVIDING THAT THAT PORTION OF ___________ STREET FROM ___________ STREET TO ___________ STREET BE VACATED, ABANDONED AND CLOSED; PROVIDING FOR THE REVERSION OF THE FEE IN SAID LAND; REPEALING ALL ORDINANCES IN CONFLICT HEREWITH; PROVIDING THAT THIS ORDINANCE SHALL BECOME EFFECTIVE IMMEDIATELY; AND DECLARING AN EMERGENCY.

    BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF EAGLE PASS, TEXAS:

    SECTION 1.

    That those portions of ___________ Street from ___________ Street to ___________ Street be and the same is hereby closed, abandoned and permanently vacated as a street or public thoroughfare of any kind or character whatever.

    SECTION 2.

    That the fee to the land in the above-described portions of said streets (and as shown on Exhibit "A" attached hereto) is hereby released and will revert to the adjacent owner as provided by law, save and except that easements are reserved for any and all existing utilities.

    SECTION 3.

    That all ordinances or parts of ordinances in conflict herewith, are hereby repealed.

    SECTION 4.

    That this ordinance shall take effect and be in full force and effect from and after the date of its passage, and it is so ordained.

    SECTION 5.

    The importance of vacating, abandoning and closing the portion of the above-mentioned street, affects the health, safety and welfare of the general public and creates an emergency requiring the suspension of the rule requiring ordinances be read on three (3) several days, and such rule is hereby suspended and this ordinance shall take effect and be in force immediately from and after its passage.
