§ 26-125. Trucks, transport apparatus; parking, loading and unloading generally.

  • All motor trucks, motor propelled trailers, semi-trailers, tractor-trailers, and transport apparatus whatsoever, designed for transport of freight, merchandise and materials, except pickup trucks having a carrying capacity of three-quarter (¾) ton or less, are hereby required to be parked, loaded and unloaded solely within and from the alley entrance to the premises at which same are being loaded or unloaded, if practicable; and where conditions are such as to make the parking, loading or unloading thereof within or from an alley impracticable, then all such vehicles shall be parked, loaded and unloaded in positions at and parallel to the curb or side line of the street only in such instances and subject to the limitations and restrictions herein provided, as follows:

    (a)

    No trailer which is not attached to a motorized towing vehicle, nor any motor vehicle having an overall length, including that of any trailer attached thereto, in excess of twenty-five (25) feet shall be parked or left standing at any time on any public street, alley, sidewalk or public way:

    South of the north line of Ford Street,

    North of the south line of Garrison Street,

    East of the west line of Ryan Street; and

    West of the Southern Pacific Railroad right-of-way,

    except for the purpose of and while actually engaged in the loading or unloading of merchandise, passengers, freight or materials to or from premises adjacent to such street, alley, sidewalk or public way.

    (b)

    No motor trucks, motor propelled trailers, semi-trailers, tractor trailers, and transport apparatus, designed for transport of freight, merchandise and materials, whether attached or detached, exceeding fifteen (15) feet in length, shall be driven, parked or left standing at any time on any public street and/or private premises located in a residential district except as specifically allowed by some other provision of this Code. All owners or drivers of the above described vehicles, must adhere to the provisions of section 26-210 for designated truck routes within the city limits of the City of Eagle Pass. Tandem trucks that are primarily used for the hauling of agricultural products are exempt from this provision.

    (c)

    Any vehicle parked or left standing on any public street in violation of this section 26-125 shall be subject to removal and impoundment as provided in section 26-129 of the Code of Ordinances of the City of Eagle Pass, Texas. Any vehicle parked or left standing in private premises in violation of this section 26-125 shall be cited and fined. Repeated citations shall constitute grounds for city to request court order to enter premises for removal and impoundment.

    (d)

    The chief of police is hereby authorized to place warning signs at such locations as he deems appropriate indicating the restrictions hereby imposed upon parking of vehicles at such locations; but the presence of such signs shall not be a prerequisite to the prosecution and conviction of any person violating any of the provisions of this section.
