Article V. LICENSE SUSPENSION/REVOCATION; APPEAL |
§ 28-23. License suspension.
(a)
The chief of police shall suspend a wrecker service company license, for one or more of the following reasons:
(1)
Failure of the licensee to maintain all wreckers or equipment in a good, safe and operational condition or failure to meet any of the requirements of section 28-3 above.
(2)
A licensee or his employee violates any provision or requirement of this chapter or any federal, state, or local ordinance.
(3)
Conviction of a wrecker service driver of a provision of the motor vehicle or traffic laws of this state or city while in the scope of his employment in the wrecker service company.
(4)
Failure of licensee to store wreckers or vehicles removed in any other area not designated as an office building/vehicle storage facility.
(b)
Such suspension shall be for a period not to exceed ten (10) days, or if the deficiency is detrimental to public safety or related to inoperable wreckers, then such suspension shall be for a period of time sufficient to correct the deficiency but for no more than twenty (20) days.
