§ 2-23. Definitions.

  • Words shall have their usual and customary meaning; however, for the purpose of these personnel rules and regulations, certain terms and words are hereby defined. Words used in the present tense shall include the future; the singular number shall include the plural, and the plural the singular. Any gender word shall be used to mean both male and female.

    Classification plan: A written plan subject to annual review and revision, which shall consist of the following:

    (1)

    A grouping of positions into classes that are approximately equal in duties and responsibilities;

    (2)

    Class titles that identify each class and describe the work of said class.

    (3)

    Written specifications for each class of employment positions containing a description of the nature of the work and of the relative responsibility of the positions in the class; illustrative examples of work performed in the class; requirements in terms of knowledge, abilities and skills necessary for performance of the work; and a statement of experience and training desirable for recruitment into the class.

    Consolidated Omnibus Budget Reconciliation Act of 1986 ("COBRA"). A federal law that provides for the continuation of group health coverage for employees who are terminated, whether voluntarily or involuntarily, for reasons other than gross misconduct, or whose hours are reduced, for either eighteen (18) or thirty-six (36) months (depending on the event) at the separated employee's expense, plus a two percent (2%) administration fee if the city imposes such fee.

    Compensatory time. Time off from work accrued at the rate of time and a half in lieu of cash payment for any overtime hours worked by non-exempt employees, as defined by the regulations for the Fair Labor Standards Act of 1938 ("FLSA"). All such time must be properly documented in an employee's official work record.

    Demotion. The transfer of an employee from a given position carrying with it certain duties, responsibilities and compensation to a position whose duties, responsibilities and compensation are less.

    Department. A major functional unit of city government.

    Department head. A person appointed by and responsible to the city manager for the administration of a department.

    Employee evaluation. An evaluation of an employee's job performance by a department head, or designee, which shall be used as a tool for making personnel decisions.

    Exempt employee. Those employees exempt from the overtime and/or minimum wage provisions of the FLSA, including employees classified as executive, administrative, professional, or computer employees who are paid on a salary basis.

    Family and Medical Leave Act of 1990 (FMLA). A federal law granting eligible employees unpaid, job-protected leave from work for certain family or medical reasons.

    Immediate family. The spouse/domestic partner, child, parent, or sibling of the employee, including step-relationships. In-law relationships are not considered immediate family members.

    Moonlighting. Employment, consulting or volunteering in an activity outside of city employment, including regular or periodic involvement with a business or company in which the employee has a principal interest or a non-profit organization in which the employee is an officer, board member, etc.

    Non-exempt employee. Those employees subject to the overtime and minimum wage provisions of the FLSA and who are generally paid on an hourly basis.

    Overtime. Refers to hours worked over forty (40) in a workweek for which non-exempt employees shall be entitled to compensation at a rate of one and one-half (1½) times their regular rate of pay.

    Pay plan. A schedule of salaries established for the various classes of positions recognized in the city's classification plan so that all positions of a given class will be paid salaries commensurate to the salary range established for the specific class.

    Position. A group of defined duties and responsibilities assigned or delegated by an appointing authority, requiring the full-time or part-time employment of a person.

    Probationary period. A working trial period following initial employment, re-employment, transfer or promotion into a budgeted position, during which an employee is required to demonstrate his/her ability to perform the duties of the position.

    Promotion. The transfer of an employee from a given position carrying with it certain duties, responsibilities and compensation to a position whose duties, responsibilities and compensation are greater.

    Re-employment date. The date of entry into a budgeted position in the service of the city following the termination date of a previous period of employment with the city.

    Regular employee. Any employee of the city who has successfully completed a probationary period in a budgeted position.

    Service credit. The credit allowed for an employee's length of service when computing certain benefits based on an employee's initial employment or re-employment date.

    Supervisor. An employee of the city with immediate responsibility over other employees.

    Temporary employee. A person employed by the city for a position which is occasioned by extra work, special projects and/or other factors which create a need for temporary labor.

    Termination pay. Payment to employees for accrued vacation, sick leave (subject to cap of two hundred forty (240) hours for employees other than firefighters), and compensatory time, if any, upon separation from employment for any reason other than gross misconduct.

    Transfer. The process of moving an employee to a different position in the same department, or from one (1) department to another, either as a promotion, demotion, or lateral position change.

    Work day. Any one (1) shift during which a department is open for business or on which an employee is scheduled to work.

    Workweek. As per the FLSA, a period of one hundred sixty-eight (168) hours during seven (7) consecutive twenty-four (24) hour periods. It may begin on any day of the week and any hour of the day established by the city manager.

    Work period. For employees engaged in fire protection activities, the work period shall consist of twenty-eight (28) days with a period of two hundred twelve (212) hours.
