§ 2-250.53. Jurisdiction and powers.
(a)
Jurisdiction. If a complaint is filed pursuant to section 2-250.54 within two (2) years of the date of an alleged violation of the ethics laws or until the ethics review commission discovers the alleged violation, or acquires knowledge of facts that, in the exercise of reasonable care and diligence, would lead to the discovery of the alleged violation, the ethics review commission shall have jurisdiction to investigate and make findings and recommendations concerning:
(1)
Any alleged violation of this code of ethics by any person subject to those provisions, including but not limited to current city officials and employees, former city officials and employees, persons doing business with the city, and persons required to register as lobbyists, or
(2)
Any alleged violation by an Eagle Pass City Official of Section 171 of the Texas Local Government Code, as amended, the state conflict-of-interest law applicable to certain local public officials.
The commission shall not consider any alleged violation that occurred more than two (2) years prior to the date of the filing of the complaint.
(b)
Termination of city official or employee's duties. The termination of a city official or employee's official duties does not affect the jurisdiction of the ethics review commission with respect to alleged violations occurring prior to the termination of official duties.
(c)
Powers. The ethics review commission has power:
(1)
To establish, amend, and rescind rules and procedures governing its own internal organization and operations, consistent with this subdivision of this code;
(2)
To meet as often as necessary to fulfill its responsibilities;
(3)
To designate ethics panels with the power to render decisions on complaints or issue advisory opinions on behalf of the commission;
(4)
To request from the city manger through the city council the appointment of such staff as are necessary to carry out its duties;
(5)
To review, index, maintain on file, and dispose of sworn complaints;
(6)
To make notifications, extend deadlines, and conduct investigations;
(7)
To render, index, and maintain on file advisory opinions;
(8)
To provide assistance to the ethics compliance officer of the city in the training and education of city officials and employees with respect to their ethical responsibilities;
(9)
To prepare an annual report and to recommend to the mayor and city council needed changes in ethical standards or procedures; and
(10)
To take such other action as is necessary to perform its duties under subdivision H of this ethics code.
