§ 5-2. Certain hours within Texas Liquor Control Act adopted.
The hours for consuming alcoholic beverages and possessing the same for consumption, and for selling beer and offering the same for sale, as prescribed in the Texas Liquor Control Act as last amended, 61st Legislature, effective September 1, 1969, for counties of three hundred thousand (300,000) or more population, according to the last preceding Federal census, are hereby adopted and made effective therefor within the city limits, to wit:
(a)
It shall be unlawful for any person to consume any alcoholic beverage in any public place or for any person to possess any alcoholic beverage in any public place for the purpose of consuming the same in such public place at any time on Sunday between the hours of 2:15 a.m. and 12:00 noon, and on all other days at any time between the hours of 2:15 a.m. and 7:00 a.m.
(b)
It shall be unlawful for any person to sell beer or offer same for sale:
(1)
On Sunday at any time between the hours of 2:00 a.m. and 12:00 noon.
(2)
On any day except Sunday at any time between the hours of 2:00 a.m. and 7:00 a.m.
(3)
It shall be unlawful for any person to sell beer on Sunday between the hours of 1:00 a.m. and 2:00 a.m., and on all other days between the hours of 12:00 midnight and 2:00 a.m., unless he shall hold a (Texas) Retail Dealer's On-Premises Late Hours License.
