Article III. SPECIAL REGULATIONS OF ON-PREMISE CONSUMPTION BUSINESS |
§ 5-32. Areas in which alcoholic beverages may be sold.
No person shall sell, give, dispense, or deliver or conduct the business of selling, giving, dispensing or delivering, or be licensed to sell, give, dispense or deliver, within the territorial limits of the city any beer or malt beverage to be consumed upon the premises where sold, given, dispensed or delivered, except within the areas below described:
Between Commercial Street (inclusive and the T. & N. O. railway track and confined to Main Street (both sides) and confined to the south side of the next parallel street north of Main Street (being the south side of Ford Street between Commercial Street and Jefferson Street, and the south side of Quarry Street between Jefferson Street and Monroe Street) and confined to the north side of the next parallel street south of Main Street (being the north side of Rio Grande Street) between Commercial Street and Monroe Street (not inclusive); and confined to the east side of Ceylon Street between Main Street and Quarry Street; and confined to that certain tract of park and commercial property lying within the following boundaries, to wit: Bounded on the east by the west line of South Monroe Street extension south from the south line of present public school property (not inclusive); Bounded on the north and northwest respectively by the south and west lines of such public school property, by the south line of Bullis Street and by the east line of South Adams Street extension south from said Bullis Street to intersection with Bliss Street; further, Bounded on the north by a line which is the present south and southwest lines of Maverick County Hospital District property extended (not inclusive) and the north line of Fort Duncan Club property extended west, along an imaginary, straight line to the west city limits line; Bounded on the west and south respectively by the west and south city limits lines; and Additionally all businesses fronting on the north side of Main Street (U.S. Highway 277) between Harold Drive and Loop 431 and fronting on the west side of Loop 431 between the north right-of-way line of U.S. Highway 277 and the south property line of Chittim Park; and fronting on the west side of Airport Road between a point on the westerly right-of-way line of Airport Road 200 feet north of its intersection with El Indio Highway and said intersection; and, also, the area shown and designated as Block 20 of Ricks Addition, Unit 2, on the subdivision plat of said Unit 2 which is of record in Vol. 2, at page 13, of the Map Records of Maverick County, Texas, which Block 20 has a frontage of approximately 400.0 feet on the east right-of-way line of U.S. Highway 277, the south line of said Block being approximately 300 feet north of Butler Road; and, also, the area shown and designated as Lot 1, in Block 1, of Holly Park Subdivision, Unit 1, on the subdivision plat of said Unit 1 which is of record in Vol. 1, at page 79, of the Map Records of Maverick County, Texas; and also a 1.64 acre tract in Survey 33, Abstract 793, in Maverick County, Texas, described by metes and bounds as follows: Starting in quest of a point of beginning at the intersection of the south line of Wilson Street and the west line of the Southern Pacific Railroad right-of-way; thence South 0 degrees 57 minutes West 200 feet with the west line of said railroad right-of-way to the point of beginning, being the northeast corner of the tract hereby described; thence South 0 degrees 57 minutes West 202.5 feet, with said railroad right-of-way to a point for the southeast corner of the tract hereby described; thence North 85 degrees 09 minutes West 515.5 feet, to a point in the east line of Monroe Street; thence North 02 degrees 16 minutes West 50 feet with the east line of Monroe Street; thence South 85 degrees 09 minutes East 200 feet with the south line of the Texas Employment Commission property; thence North 02 degrees 16 minutes West 151.7 feet to a point for the northwest corner of this tract; thence South 85 degrees 25 minutes East 326.8 feet to the point of beginning and, also, the area shown and designated as Tract B-6, Carthage Place, Unit I, on the subdivision plat of said Unit I, which is of record in Envelope 88, Side 2, of the Map Records of Maverick County, Texas, reference being here made to said plat, and the record thereof, for further description of said land and for all purposes pertinent hereto, which Tract B-6 has a frontage of approximately 135.41 feet on the east right-of-way line of FM 375.

Being a 28.539-acre tract of land situated in Maverick County, Texas, and being out of Survey 35½, Abstract 1240, Day Land and Cattle Company, original grantee, and being more particularly described by metes and bounds as follows: Commencing at the northeast corner of Survey 32 1/3 , Abstract 1239, and the southeast corner of said Survey 35½, a fence corner marked by an iron rod; thence along the common line between Survey 32 1/3 and Survey 35½, south 89 degrees 41 minutes 45 seconds west, crossing the easterly line of F.M. Highway 375 at 242.68 feet and crossing the westerly line of F.M. Highway 375 at 308.19 feet, in all 798.09 feet to the point of beginning of the tract of land herein described; thence 0 degrees 00 minutes 19 seconds west, a distance of 1650.90 feet to a point; thence 0 degrees 02 minutes 22 seconds east, a distance of 700.46 feet to a point, said point being in a curve to the left whose center bears north 36 degrees 29 minutes 20 seconds east, a distance of 579.3 feet; thence along said curve in a westerly direction through a central angle of 36 degrees 52 minutes 29 seconds, a distance of 372.83 feet to the end of said curve; thence north 89 degrees 36 minutes 51 seconds east, a distance of 379.70 feet to a point in the westerly right-of-way line of said F.M. Highway 375; thence south 0 degrees 23 minutes 09 seconds east, along said highway right-of-way a distance of 1545.32 feet to the beginning of a curve to the right whose center bears south 89 degrees 36 minutes 51 seconds west, a distance of 543.0 feet; thence along said curve in a southwesterly direction continuing with said highway right-of-way, through a central angle of 14 degrees 43 minutes 38 seconds, a distance of 139.58 feet to a point; thence south 89 degrees 59 minutes 41 seconds west, a distance of 117.37 feet to a point; thence north 0 degrees 00 minutes 19 seconds west, a distance of 55.09 feet to a point; thence south 89 degrees 59 minutes 41 seconds west, a distance of 555.10 feet to a point; thence south 0 degrees 00 minutes 19 seconds east, a distance of 611.71 feet to a point in the south line of said Survey 35½; thence south 89 degrees 41 minutes 45 seconds west, with said survey line, a distance of 49.50 feet to the point of beginning and containing 28.539 acres of land.
