§ 5-34. Number of businesses selling alcoholic beverage for consumption on premises limited.

Conducting a business as described in section 5-32 is prohibited even within the areas defined in that section in the following circumstances:

(1)

Where such business, if so approved, licensed and conducted would increase the number of such businesses being conducted at the same time, within the territorial limits of the city, to exceed the ratio of one (1) such business for every five hundred (500) or fraction thereof inhabitants, according to the population figure established by the last federal census.

(2)

Where such business, if so approved, licensed and conducted, would increase the number of such businesses being conducted at the same time within any one (1) given city block to exceed the number of four (4) such businesses within such city block.
