§ 5-37. Juke boxes not to be played in a manner so as to cause a disturbance.

  • (a)

    It shall be unlawful for any person to use or permit to be used, at any time between the hour of 12:00 midnight and 8:00 a.m., any juke box or other device, used or designed to reproduce or intensify or amplify music or other sounds on any premises or establishment where any intoxicating beverage is sold, served, dispensed or given, for on-premises consumption, within the city.

    (b)

    It shall be unlawful for any person to operate or permit operation of any device described in paragraph (a) of this section located in any establishment as described in paragraph (a), at any time, at such a volume or intensity as to disturb persons of ordinary sensitivity located outside such establishments.

    (c)

    Every person holding a retail license under the State Liquor Control Board of Texas pertaining to any on-premises establishment, where there is located any such operative juke box, shall maintain the same equipped at all times with a key or other device to permit manual control of the intensity or volume and shall reduce such intensity or volume promptly upon the order of the chief of police or any other peace officer to do so. Upon complaint of three (3) or more credible persons, and in the event of refusal or failure otherwise to obey any such lawful order, the chief of police or other peace officer promptly may arrest without warrant any such offender while such violation and disobedience continue, and shall reduce such intensity or volume, forthwith.
