§ 8-125. Expenses to be assessed on lien against property.

If the city incurs expenses under section 8-124, the city may assess the expenses on, and the city has a lien against, unless it
is a homestead as protected by the Texas Constitution, the property in which the dangerous
building is or was located. Expenses incurred by the city under section 8-124 shall include the cost of labor, materials, and any other related costs plus an administrative
fee of two hundred fifty dollars ($250.00). The lien is extinguished if the owner
or any other person(s) having an interest in the legal title to the property reimburses
the city for the expenses. The lien shall be recorded and indexed in the Maverick
County Clerk's Office and the lien arises and attaches to the property at the time
the notice of lien is so recorded and indexed. The notice of lien and notice of assessment
must contain the name and address of the owner, if that information can be determined
with a reasonable effort, a legal description of the real property on which the building
is or was located, the amount of expenses incurred by the city, and the balance due.
The notice of lien and notice of assessment shall be sent to owner at the last known
address at the time the lien attaches requesting that the balance due be paid immediately.
