Division 2. REPAIRS OF BUILDING BY CITY; PENALTIES FOR VIOLATIONS |
§ 8-141. Authority.
In addition to the rights of the city under division 1 of this article, after the expiration of the time allotted under section 8-122, for the repair, removal, or demolition of a building, the city may:
(1)
Repair the building and assess the expenses on the land on which the building stands or to which it is attached; or
(2)
If the city proves that:
a.
The property owner was notified of the requirements of division 1 of this article and the owner's need to comply with the requirements, and
b.
After notification, the property owner committed an act in violation of this article or failed to take an action necessary for compliance with this article, assess a civil penalty in an amount not to exceed one thousand dollars ($1,000.00) per day against the property owner of the building for failure to repair, remove, or demolish the building. Each day that the owner of the building fails to comply with the city's ordered action after the expiration of the time period in which to act as provided in this article shall constitute a separate civil penalty. If the owner shows that the property is the owner's lawful homestead, the civil penalty shall be in an amount not to exceed ten dollars ($10.00) per day.
