§ 4-5. Election by majority and run-off elections.

  • At every regular or special election called to fill one or more vacant positions on the council, election to each such position shall be by a majority of all the votes cast for such position at such election, to wit:

    (a)

    In every such election each qualified voter shall vote for not more than one candidate for mayor and for each council position to be filled.

    (b)

    In the event that no candidate receives a majority of all the votes cast for such position at said election, the council shall, immediately upon declaring the official results of the election, issue a call for a run-off election for every position to which no one was elected.

    (c)

    Said run-off election shall be held as prescribed by state law.

    (d)

    In said run-off election the two (2) candidates who received the highest number of votes for each position to which no one was elected in the preceding election, shall be voted on again.

    (e)

    The candidate who then receives the majority of the votes cast for each such position in the run-off election shall be elected to said position.
