§ 11. "F" Floodway district.

The following regulations shall apply to the "F" Floodway district.

A.

Use regulations: A premise may be used only for the following purposes, provided the permitting of such use shall not constitute a representation, guarantee, or warranty of any kind or nature by the City of Eagle Pass or the planning and zoning commission, or any officer or employee of either, thereof, of the practicability or safety of any building or structure or use of land proposed and shall create no liability upon, or cause of action against such public body, officer, or employee for any damage that may result pursuant thereto.

(1)

Agricultural uses, including farming, orchards, grazing, livestock raising, or gardens.

(2)

Public or private recreational facilities (such as golf courses, baseball fields, football fields, playgrounds, picnic areas, park uses, etc.).

(3)

Temporary revivals.

(4)

Open type uses such as loading and unloading areas.

(5)

Circus, carnival, and similar transient amusement enterprises.

(6)

Parking lots for vehicles.

(7)

Drive-in theaters.

(8)

No permanent buildings and structures shall be allowed. Other temporary buildings and structures in connection with the above uses will be permitted by special written permit from the city council following a recommendation by the planning and zoning commission and provided such building or structure is of a type not appreciably damaged by flood waters and provided any such building is so designed and placed on the property to have no effect upon the flow of flood waters, and provided no structure shall be permitted for human residence occupation.

B.

Height regulations: No temporary building shall exceed two and one-half (2½) stories or thirty-five (35) feet in height except as provided in section 11 hereof.

C.

Yard regulations: There are no yard regulations in this district.

D.

Intensity of use: There are no minimum lot area requirements in this district.
