Article II. INDOOR PLUMBING FIXTURES AND INSULATION OF EXPOSED HOT WATER PIPING |
§ 21-50. Violation; penalties.
(a)
It shall be a violation of this article to sell, purchase or install plumbing fixtures not in accordance with the provisions of this article.
(b)
A person commits an offense and it shall be a violation of this article if a person knowingly or intentionally fails to comply with each and every one of the provisions of this article. Let is also be known that:
(1)
Each day of a continuing violation is a separate offense.
(2)
A single citation shall be issued for each noncompliant fixture sold or purchased, or installed within a building, regardless of the number of noncompliances. The owner of the building and/or person who acquired the building permit shall be subject to a fine not to exceed two hundred dollars ($200.00) per citation.
(c)
A violation of this article shall be a criminal offense, a Class C misdemeanor punishable by a fine of not less than two hundred dollars ($200.00) or more than five hundred dollars ($500.00). If it is shown on the trial of the defendant that the defendant has been convicted of an offense under this article, the court shall also order such person to correct all noncompliances within the building for which the citation was issued.
