Division 1. IN GENERAL |
§ 27-42. Privies declared nuisances; removal; lien for removal by city.
It is hereby declared unlawful to have any privy within the city, or to have a privy located on any premise outside the city limits which lies within two hundred (200) feet of the city sewer system.
Any such privy is declared a nuisance and shall be immediately abated. All privy pits shall be completely filled.
Failure to comply with this section, after due notice and proper hearing, shall constitute authority for the city to remove the privy and fill in the pit. All costs accruing to the city as a result of taking such action shall constitute a lien of such premises until all such costs plus six (6) percent be paid.
